THE COMOX VALLEY 30-DAY LOCAL FOOD CHALLENGE (“CONTEST”)
This contest is governed by Canadian law
HOW TO ENTER:
No purchase necessary. Contest begins on June 25, 2011 at 12:00:01 a.m. Eastern Time (ET) and ends on Aug. 2, 2011 at 11:59:59 p.m. ET (the “Contest Period”). Pick up your Challenge Passport at the Comox Calley Farmer’s Market, Canada Day celebrations in Lewis Park or any Food Challenge event through July 13, 2011. To register, go to www.eatcomoxvalley.com, click on registration link, and an entry form will appear. Fully complete the entry form (which requires your challenge passport ID, full name, phone number, e-mail, number of family members) and click the “submit” button to complete your registration. Once registered, your Challenge Passport is valid and needs to be completed as well as deposited in the ballot box located any of the above locations at the end of the Contest Period (the “Entry”). Your Entry must be received within the Contest Period. All eligible entries received during the Contest Period will be entered in the random draw. Limit of one (1) Entry per person/email address permitted during the Contest Period. If it is discovered that you attempted to enter more than once during the Contest Period, then all your entries will be void. Entries will be rejected if registration form and Challenge Passport are not fully completed and submitted during the Contest Period. Use of any automated or robotic system to enter is prohibited and will automatically result in disqualification.
ELIGIBILITY:
Contest is open to all legal residents of British Columbia who are 19 years of age or older at the time of entry, except employees or agents (and those with whom such persons are domiciled) of Our Big Earth Media Co. (the “Sponsor”),. Comox Valley Record, Comox Valley Chamber of Commerce, Community Futures Strathcona, Bernardin Canada, Hellmann’s Canada, Discover Comox Valley, the BC Shellfish Growers Association, their respective advertising and promotion agencies and the contest judges.
THE PRIZES AND APPROXIMATE RETAIL VALUE:
There will be one (1) Grand Prize awarded consisting of a culinary adventure to the Okanagan and two $600 gift certificates. One from the restaurant on the Challenge Passport that received the highest rating on the Entries submitted and one from the food producer with the same. Challenge participants will rate their favourite dining experience and the restaurant/food producer with the highest overall rating will host the grand prize food experience. There will be one (1) second prize awarded consisting of a $750 gift basket from the Comox Valley Farmers Market Association. There will be one (1) third prize awarded consisting of a $500 gift basket from the Comox Valley Farmers Market Association. Prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at Sponsor’s option. Sponsor reserves the right to substitute a prize or a prize component with one of equal or greater value. Limit of one (1) Prize per person/email address. Prizes will only be awarded to the person whose name and email address appears on the Entry.
DRAW AND WINNER SELECTION:
On August 3, 2011 (“Draw Date”) in Courtenay, B.C. at approximately 3 p.m. ET, eligible entrants will be selected by random draw from among all eligible entries received during the Contest Period. The odds of winning depend on the total number of eligible entries received. Acting reasonably, the Sponsor will attempt to contact each selected entrant by phone or email within ten (10) business days of the Draw Date. If a selected entrant cannot be contacted within ten (10) business days of the Draw Date or there is a return of any notification as undeliverable, that selected entrant will be disqualified and an alternate entrant will be randomly selected from among the remaining eligible entries. Before being declared a winner, each selected entrant will be required to: (a) correctly answer a time limited mathematical skill testing question; and (b) sign and return within ten (10) business days of notification a declaration and release form confirming compliance with these Contest Rules, acceptance of the prize as awarded and releasing the Sponsors, their advertising and promotion agencies, the contest judges and each of their respective officers, directors, agents, representatives, successors and assigns from any liability in connection with this Contest, the selected entrant’s participation therein and/or the awarding and use/misuse of a prize or any portion thereof (“Release”). If the selected entrant: (a) fails to correctly answer the skill testing question; or (b) fails to return the Release within the specified time, then he/she will forfeit the prize and an alternate eligible entrant will be randomly selected from among the remaining eligible entries. Grand Prize guests (and their parent/legal guardian if they are a minor) must also sign a Release.
GENERAL CONDITIONS:
By entering the Contest, each selected entrant agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet. All entries become the property of the Sponsor, which assumes no responsibility for lost, delayed, incomplete or misdirected entries. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the contest judges with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries.
Without limitation, the Sponsors, their advertising and promotion agencies and the contest judges (“Releasees”) will not be liable for any failure of the website during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Releasees for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Further, the Releasees will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the Contest.
In the event of a dispute as to who submitted an entry, the entry shall be deemed submitted by an “authorized e-mail account holder” and entries will be declared made by the authorized e-mail account holder of the e-mail address submitted at the time of entry. “Authorized e-mail account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be requested to provide Contest Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the potentially winning entry.
You agree that you will submit any dispute you may have with regard to the Contest (including, without limitation, regarding the interpretation of these Contest Rules and/or the awarding of prizes) to Our Big Earth Media Co., whose decisions regarding all such disputes shall be final and binding on all entrants without right of appeal. All disputes must be submitted in writing and sent to us at: info@ourbigearth.com
The Sponsor reserves the right to withdraw or amend this Contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Contest Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
The Sponsor reserves the right to cancel or suspend this Contest or to amend these Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind.
By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering the Contest and in accordance with Sponsor’s Privacy Policy (available at: http://www.ourbigearth.com/about/privacy-policy/), unless the entrant otherwise agrees.
